Im a proud member of the TransAction 2007 action group, that lobbys the government with regards fuel taxation in the interest of primarily hauliers and farmers, but also everyone in the country. Anyway, after a recent discussion on the TransAction forums, someone bought some interesting details to light, and just wanted to gauge you're thoughts on this small matter, that may mean our prices are as much as 10p high than they legally should be: If a litre of fuel costs £1.07p. This is how it breaks down.
50.35p is Fuel Duty 32.60p is Product 16.07p is VAT 8.88p is Retailer/Delivery 8.8p of the VAT is chargeable on the fuel duty, which is tax. This isnt a product, it is a tax. Only 7.9 of the VAT is actually on the product. A member on TransAction raised this point, and I believe there may be some serious grounds for concern with regards it, and that we may be getting ripped off, even robbed, by our government. How can it be legal to charge VAT (8.8p per litre) on fuel tax?
Isn't VAT a Value Added Tax? How does fuel tax 'add value' to fuel, meaning value to the purchaser, not the government? If it means add tax to the value of the product then it is still wrong - fuel tax is not a part of the 'product'.
By all means add VAT to the product + retail + delivery cost, but adding it to the fuel tax simply cannot be right as tax is not a 'product or service'. I know the government do pretty much what they want to regardless of how legal/illegal it may be, however VAT rules are no imposed by the EU, so does anyone else know if this is legal? What are you're thoughts on this? I think its a very valid point, and I think I will be looking into this further. I may even go so far as to contact Angela Eagle to see what response Labour will give to such a question.

I wasnt even aware of this...good find. It certainly doesnt sound Legal at all  Thats pathetic that theyre somehow getting away with swindling that little bit extra out of us decent folk... An email will most likely not get you the results ya want....cos it never does.....but its worth a shot

wow, such a simple thing that can easily go un-noticed, bet it was an accountant that sussed it, not that it bothers them cos they be vat registered anyway and get it all back, the gov is clearly over-taxing the fuel,how wrong is that to average joe (not you bmw)
needed to change this for years. so now i have. ha

I wish this country would do something about it and not just moan about it.

tell me about it, £51.62 for 40 litres then in tesco, whats this place comin too, i'm really depressed over it.
I remember when i used to put it in and stop on the pound, now i stop on the litre, ridiculas.
Uncertainty or not knowing causes depression, Im happy because I know I'm going to die one day!

I remember when i used to put it in and stop on the pound, now i stop on the litre, ridiculas. Thats how I used to feel matey, changing from the pound to measuring in litres. Gone to Biodiesel now, keep putting £20 in and getting just over 22 litres, so not so bad for me, but still wouldn't mind a few extra pence off per litre if it turns out that this VAT rule is illegal.

sad innit matt  Yeah, and its only going to get worse; $135 a barrel now and increasing an average of $2.00 a day, I remember the days when the markets were reeling in a state of shock because it hit $68 a barrel!! And the government still insist they want to add the 2p tax in October, despite making millions extra from the additional VAT due to pump price increase. And now they are also talking about stopping the lower tax level for biofuels (such as biodiesel and bio-ethanol) and maybe even scrapping the LPG tax break by 2010 (biofuels tax increases could come into force in 2009).
