here is my dilema,been working fo a company for a few months now i was struggling to get into work and the boss said i could buy one of her cars off her and take it it out of my wages.then on sunday 26th of last month i felt ill whilst driving i informed boss i couldnt carry on,went into work last thursday and got called into office were they said i needed a back to work note and they felt i wasnt fit enough to come back to work,then it went from being fit to work to my attitude at work,we had a slight argument were i felt i was being unfairly treated and would seek advise.on my way back to my car the boss ran out and snatched keys from car and said i was only hiring the car which is a lie i have paid nearly 1800 hundred pounds off this car she holds the log book,i have asked for a copy of the hire agreement i feel if i go back into work i will picked on and made to feel uncomfortable.any advise please.

Was any thing put in writing, or was it just word of mouth, if you have nothing on paper it appears to be your word against your boss. You said you've been there a couple of months and paid £1800, seems pretty steep, I would make an appointment with the C.B.A. Also you didn't say if you still work there, if you do why take the car away from you !!!!

There must be a record of the money you have paid, deductions from your wages,do you have a copy of your contract of employment? gather all your information and go to the C.A.B or there are advice centres run by some groups with unions who will help good luck let us know how you get on

That's a really crappy situation to be in Eddie. There should be deductions noted on your payslips, these shall be your proff of payment for the vehicle but you need something to proove you were paying for the purchase of the car and not the hire of it.
Also make a note of how you have been treated.
Seek advise from the cab as this is serious.
Hope you can sort it out.

I agree with the above comments go to cizens advice . what year was the car ? if you have only been there a couple of months .thats alot out your wages . good luck keep us updated .

just because they (your boss) have the log book does not mean they are the legal owner.
However, under a hire purchase agreement its normally there's until the last payment.
keep any payment going, as not paying could breach an unwritten agreement.
Get Advice as mentioned.

thanks for your replies,i have just been informed i am on unpaid leave even though i am fit for work,the situation is i was on a section 88 from dvla which means i can drive until i had a ecg exercise test.earlier last month informed company had got date for test so i could keep my appointment for test there was a mix up at work and they had altered my duties i pointed this out on the day of my test to be told i had to stay and finish my dutie,my dutie before it was altered was five in morning to half three in afternoon the new dutie was 10.50 in morning to 18.30 at night my appointment was at 16.30 told the manager who was in charge that day i couldnt stay she informed me i was getting sent home without pay i had to keep this appointment to keep my licence gladly to say passed test so i have just been waiting to get my license sent to me the company knows this,it feels to me because i went ill the other week and they had no one to cover for me i feel am being singled out probably someone from the company will read this and i will be sacked but being in the job i am in and the type of viechle i drive i will not put people at risk if i think i done the right.

A daft one, if i understand correctly your fit for work but they wont pay you. if that's the case you could be entitled to job seekers allowance.
i know its crazy, but your fit for work. this is a breach of a work contract.
if you have oily been there a few months i think the outcome will be grim.
call acas over the work situation, the car is another matter.

dont get me wrong i love the job i am in and the drivers i work with i just dont like the way i am being treated,iv done nothing wrong as far as i know,im a professional driver who has worked hard for this company they have helped me and i have helped them but i dont know wether it could work anymore i feel let down by them.

that sounds like it would fall under disability discrimination,if you need your license for your job and have to prove your ability by way of ecg at the request of the dvla.your employer has acted illegally by denying you time to go to that appointment i reckon.hope you have proof of car payments etc,good luck!

They're not being very nice about it, but they want rid of you. If you've been there less than 12 months they can dismiss you without notice and without a redundancy payment. Time to find another job.
As others have said, without paperwork for the car to show an agreement (whether to buy or hire) exists, you don't have a leg to stand on. It'll be your word against theirs.

well got sacked as i thought i would,letter states due to attitude with managers,now my thinking is it can only be due to medical reasons to which they deny,or is it because i was asked to do route training with a map while doing a school run.anyone knows by law you cant drive and read a map and im sure if any parent reading this would be horrified to know that it does happen.as i have said i am a professional driver i take passengers life very serious especialy children people need to know what drivers are asked to do and should also look at the company that is doing it.if any body needs a driver please let me know oh and i never got car back,thanks for all your replies.

Perhaps you should ask the tax man to investigate their 'car hire' accounts, now you're not with them (Sorry to hear that).
And perhaps the police might like to investigate the insurance cover arrangments for this vehicle?

Sorry to hear that you have lost your job, listen, make sure you get the pay which is due to you, don't listen to any stories they try to fob you off with. Get what's owed to you. My uncle works in the public transport sector, I will ask if there maybe any available positions.
